Warranty and Administration

• The Customer acknowledges that the Platform provides shipping and delivery services for items displayed within its digital marketplace and manages order processing and warranty administration solely as a marketing and organizational intermediary.
• Packages are registered under the Customer's name within the Platform's system solely for internal order management purposes and in accordance with the specifications announced at the time of the order.
• Such registration does not grant the Customer any legal right to officially register the package with any external authority, claim ownership rights, manufacturing rights, or impose obligations on the Platform beyond the scope of its services.
• The Platform undertakes only to manage orders and deliver registered packages according to the provided information and their sources, without guaranteeing product quality, content, or suitability for any particular purpose.
• All delivery data, methods, and sources constitute part of the Platform's internal operations, and the Customer shall have no right to request disclosure of such information or communicate regarding it.

Scope of Service

• The service includes access to international shipping and delivery services through an electronic platform, communication with the Platform (HighFlyer Worldwide), and completion of transactions and marketing activities through the Platform.
• The Customer may browse the services and receive notifications via email or through the Platform.
• The Platform reserves the right to amend these Terms and Conditions.

Platform Obligations

• The Platform shall facilitate the Customer's access to international markets through the Platform.
• The Platform shall provide a reasonable level of technical support related to the use of the Platform.
• The Platform shall protect Customer data and shall not share it with third parties except where required for the execution of the service.

Customer Obligations

• The Customer shall provide accurate information during registration and ordering, including name, address, payment methods, and related information.
• The Customer shall pay all amounts due for the services according to the stated payment terms.
• The Customer shall not use the service for any illegal, fraudulent, immoral, obscene, unauthorized, or prohibited purposes or shipments.
• The Customer further undertakes that all use of the service shall comply with all applicable international, federal, state, and local laws, including laws relating to banking services, anti-money laundering regulations, commercial sanctions, and terrorist activities.

Payment Policy

• The Customer is required to pay the full value of the services through the payment methods available on the Platform upon order confirmation or through any methods deemed appropriate by the Platform.
• If payment fails or cannot be completed, the order shall automatically be cancelled by the system, and the Customer may retry payment or submit a new order according to the Platform's procedures.
• The Customer shall receive a receipt, invoice, or any document evidencing payment for the order, and such document shall form an integral part of these Terms and Conditions without invalidating any of their provisions.

Cancellation and Refund Policy

• The Customer shall not be entitled to any refund of amounts paid except where the order is cancelled by the Platform or where the Platform is unable to provide the service.
• The Customer shall not be entitled to any refund after completion of the order except where the transaction is cancelled before the funds are transferred.
• The Customer shall not be entitled to recover any portion of the service fees.

Delivery and Collection Policy

• Delivery shall be completed within a period of up to forty-five (45) days from the date of order confirmation and receipt of the required payment in accordance with the Payment Policy above.
• Delivery shall be carried out through independent shipping companies, and the risk of damage shall transfer in accordance with the agreed shipping terms. Cooperative Takaful insurance may be arranged upon request and subject to availability, with the cost borne by the Customer.
• The Platform shall not be liable for losses arising from force majeure events or circumstances beyond its control.
• In the event of delay in shipping or delivery due to circumstances beyond control, the Customer shall not have the right to cancel or request a refund unless otherwise agreed.
• The Customer or recipient shall adhere to the agreed collection or delivery schedule approved by the Platform and may not alter or reschedule it.
• The Customer or recipient must attend personally to collect or receive the package or authorize a representative in advance through written authorization or confirmation through direct communication channels with the Platform.
• Failure by the Customer or recipient to attend or collect the package at the agreed time shall render the Customer responsible for any fees or consequences arising from such failure.

Prohibited Items

• The Customer acknowledges responsibility for all expenses, fines, taxes, or violations arising from attempting to ship prohibited or unauthorized items and agrees to indemnify the Platform for any such amounts incurred.
• The Customer's attention is specifically drawn to the prohibited and restricted items policies of the approved shipping and delivery companies used by the Platform.
• The approved shipping and delivery company reserves the right to open and inspect any shipment sent by the Customer without prior notice to ensure that it complies with customs procedures and the standard handling requirements of the carrier and is eligible for transportation to the destination country.
• The approved shipping and delivery company does not guarantee that any specific item is transportable without violating the laws of any country, state, or jurisdiction through which the shipment may pass.

Return Policy

• Returns shall be governed by the return policy of the approved shipping and delivery company used by the Platform and by these Terms and Conditions.
• The Platform shall only implement return requests within the limits of its role as a marketing and organizational intermediary.
• Such operations shall also be subject to the Delivery and Collection Policy, Force Majeure provisions, and the terms and conditions of the approved shipping and delivery company.
• The Platform shall not be obliged to provide any financial or legal compensation to the Customer if the shipping company refuses replacement or return requests.

Force Majeure

• Force majeure events include, without limitation, maritime, air, and land accidents, natural disasters, wars, strikes, port closures, government decisions, or any events beyond reasonable control.
• The Platform shall not be responsible for damage, destruction, delays, inability to provide services, or additional shipping fees arising from force majeure events or circumstances beyond its control, including failures of electronic payment systems, internet outages, or similar events. Any applicable claims shall be referred to the shipping company or insurer.

Dispute Resolution

• In the event of any dispute between the parties, efforts shall first be made to resolve the matter amicably whenever possible. If amicable resolution is not possible, the dispute shall be referred to judicial arbitration in the State of Kuwait in accordance with the applicable arbitration laws and regulations. Notices shall be sent to the First Party's registered address unless the First Party notifies otherwise through registered written notice.

Customer Acknowledgment and Acceptance

• By using the Platform or completing an order, the Customer acknowledges that they have read, understood, and agreed to all of these Terms and Conditions. These Terms and Conditions shall form an integral part of every shipping order, receipt, invoice, or document issued by the Platform, and the Customer agrees to be fully bound by them.
